WeFundWe ("we," "us," or "our") operates a crowdfunding platform accessible at https://wefundwelive.com (the "Platform"). Our Platform enables individuals and organizations ("Campaign Organizers") to create fundraising campaigns for personal causes, charitable purposes, medical expenses, disaster relief, veteran support, entrepreneurial ventures, faith-based initiatives, and other lawful purposes. Users ("Donors") may contribute funds to campaigns of their choosing. By accessing or using our Platform, you agree to be bound by these Terms of Service ("Terms").

2. Eligibility

To use WeFundWe, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into a binding agreement
• Provide accurate, current, and complete information during registration
• Not be prohibited from using our services under applicable laws
• Not have been previously suspended or removed from the Platform

If you are creating a campaign on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. User Responsibilities

As a user of WeFundWe, you agree to:

• Provide truthful, accurate, and non-misleading information in all campaigns and communications
• Use funds received through campaigns solely for the stated purposes
• Respond promptly to reasonable inquiries from donors and WeFundWe
• Comply with all applicable local, state, national, and international laws and regulations
• Maintain the security of your account credentials and notify us immediately of any unauthorized access
• Not use the Platform to harm, threaten, or harass others
• Provide updates to donors regarding campaign progress and fund utilization when appropriate

4. Campaigns and Donations Disclaimer

Important: WeFundWe is a platform that facilitates connections between Campaign Organizers and Donors. We do not guarantee the accuracy, completeness, or truthfulness of any campaign information.

• WeFundWe does not verify the identity of Campaign Organizers or the legitimacy of campaigns
• Donations are made at the Donor's own risk and discretion
• WeFundWe does not guarantee that funds will be used as described by Campaign Organizers
• Donations are generally non-refundable once processed, except in cases of fraud as determined by WeFundWe
• WeFundWe is not responsible for tax implications of donations; consult a tax professional for guidance
• Donations through WeFundWe may not qualify as tax-deductible charitable contributions unless the campaign is operated by a registered 501(c)(3) organization

5. Fees

WeFundWe charges fees for the use of our Platform:

• Platform Fee: A percentage of each donation may be retained by WeFundWe to support platform operations and development
• Payment Processing Fees: Third-party payment processors (such as Stripe) charge fees for processing transactions, which are deducted from donations
• Withdrawal Fees: Additional fees may apply when transferring funds to Campaign Organizers' bank accounts

Current fee schedules are displayed during the campaign creation and donation processes. WeFundWe reserves the right to modify fees with reasonable notice to users.

6. Prohibited Activities

Users are strictly prohibited from:

• Creating fraudulent, misleading, or deceptive campaigns
• Impersonating another person or entity
• Raising funds for illegal activities, including but not limited to drugs, weapons, or terrorism
• Posting content that is defamatory, obscene, hateful, discriminatory, or violates others' rights
• Using the Platform for money laundering or other financial crimes
• Attempting to circumvent Platform fees or payment processing
• Interfering with the Platform's functionality or security
• Scraping, harvesting, or collecting user data without authorization
• Using automated systems or bots to interact with the Platform
• Promoting pyramid schemes, multi-level marketing, or get-rich-quick schemes
• Violating any applicable laws, regulations, or third-party rights

7. Intellectual Property

WeFundWe's Intellectual Property: The Platform, including its design, logo, graphics, software, and content created by WeFundWe, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

User Content: By posting content on WeFundWe (including campaign descriptions, images, and updates), you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content in connection with operating and promoting the Platform. You represent that you own or have the necessary rights to all content you post.

DMCA Compliance: If you believe content on our Platform infringes your copyright, please contact us at support@wefundwelive.com with a detailed description of the alleged infringement.

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF CAMPAIGN INFORMATION
• WARRANTIES THAT DEFECTS WILL BE CORRECTED

WeFundWe does not endorse any campaigns, Campaign Organizers, or causes. We are not a broker, financial institution, or charity. Any reliance on information provided through the Platform is at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEFUNDWE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from campaigns, donations, or interactions between users
• Actions or omissions of Campaign Organizers, Donors, or third parties
• Unauthorized access to or alteration of your data
• Any matter beyond our reasonable control

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT OF FEES PAID BY YOU TO WEFUNDWE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Termination

Termination by You: You may close your account at any time by contacting us at support@wefundwelive.com. Outstanding obligations (including pending campaign disbursements) will survive termination.

Termination by WeFundWe: We reserve the right to suspend or terminate your account, remove campaigns, or restrict access to the Platform at our sole discretion, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or suspicious activity
• Request by law enforcement or government agencies
• Extended periods of inactivity
• Technical or security issues

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.

11. Changes to Terms

WeFundWe reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically. If you do not agree to the modified Terms, you must discontinue use of the Platform.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in class action lawsuits against WeFundWe.
